PARTICIPANT LIABILITY WAIVER

In consideration of being permitted to use the facilities at Kid’s Funhouse LLC, I hereby agree to release, indemnify and discharge Kid’s Funhouse LLC, its agents, owners, shareholders, directors, partners, employees and volunteers (the “Associated Parties”), on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1. I understand that participation in Kid’s Funhouse LLC activities/parties are risky and that risks of injury include without limitation, scrapes, bruises, cuts, and even more serious injuries, such as paralysis or death, and I fully accept and agree to assume all of these risks (including risks arising from the negligence of other participants), for myself and all children in my supervision. I understand that it is my responsibility to supervise the children listed below when they are participating in activities/parties at Kid’s Funhouse LLC, not the responsibility of Kid’s Funhouse LLC, I will obey and will make sure that all children under my supervision obey the rules posted at Kid’s Funhouse LLC. I understand that violation of rules could result in expulsion from Kid’s Funhouse LLC. I understand that such risks cannot be eliminated without jeopardizing he essential qualities of the activities. 
2. I release Kid’s Funhouse LLC and all Associated Parties from any and all claims, demands, or causes of action, which are in any way connected with my or my child/those under my care participation in this activity or use of Kid’s Funhouse LLC equipment or facilities.
3. I agree that if the participant is a minor, this Participant Liability Waiver is made on behalf of that minor and that all release, waivers and promises herein are binding on that minor participant. I represent that I have full authority as parent or legal guardian to bind the minor participant to this Participant Liability Waiver.
4. I indemnify and save and hold harmless Kid’s Funhouse LLC and all Associated Parties against any loss, liability, damage or cost that may incur arising out of or in any way connected with the participation in Kid’s Funhouse LLC.
5. By signing this Agreement, I acknowledge that I have had sufficient opportunity to read this entire Agreement, I understand it completely, I understand that it affects my legal rights, and I agree to be bound by its terms.
